How much do you charge for your services? Consultations Are Free; There Is No Legal Fee Unless We Recover Money on Your Claim.
We will handle your personal injury claim on a contingency fee basis. This means that we will take only a percentage of any money recovered in the lawsuit. In most cases, the fee is 33 1/3% of the sum recovered.
How much time do I have to commence a lawsuit? For most personal injury actions, you must commence an action within three (3) years of the date of the accident (two and a half years for medical malpractice actions). However, where the responsible party is a city, county, town, village, fire district or school district (or their employees and agents), a Notice of
Claim must be filed within Ninety (90) days and the lawsuit must be commenced within One Year and Ninety Days (Sometimes only one year). In certain other types of matters, necessary filings must be made within thirty (30) days so it is extremely important that you contact us immediately if you suspect that someone was at fault for your injuries.
How long will a case take to come to a resolution? This is a common question which is extremely difficult to answer due to the many various individual factors unique to each lawsuit. While we will attempt to bring your matter to resolution as expeditiously as possible, it is important to understand that a lawsuit is a process and does require some patience in achieving a result that fairly compensates an injured person.
Throughout the process, we will keep you informed of all important developments in your case and will promptly respond to all inquiries that you have regarding your claim.
What if I was partially at fault for my accident? Even if you were partly at fault for your accident, you will still be able to recover from the other responsible parties in proportion to their fault. In other words, if you sustained, for example, $100 in damage in an accident where you were 50% at fault, you can still recover $50 from the other responsible party(s). The amount of damages and the percentage of fault can be determined by the court.
